Your Immigration & Illegal Working Obligations Made Easy – The Adams WayWritten by: Jill Gray |
 |
Reputational risk in today’s information age is more damaging than ever. With immigration constantly in the news, it is no wonder that employers of non-British nationals are becoming increasingly aware of the need to comply with the illegal working regime. From the smallest restaurant to multi-national corporations, ‘right to work’ checks and the accompanying HR requirements are now a legal obligation. All companies should now be treating their immigration compliance with the same degree of care that they afford their HMRC obligations.
As businesses look to enhance their workforce in these difficult times, there is no doubt that sourcing staff from overseas can make economic sense. Increasingly, companies are finding themselves in possession of a staff portfolio peppered with Tier 1 migrants, Tier 2 migrants, work permit holders, Tier 4 students and also workers from the EU Accession states.
It is essential that these diverse workforces are managed in order to comply with immigration obligations as failure to comply can result in civil penalties of up to £10,000 per illegal employee. Moreover, knowingly employing an individual with no right to work can result in a criminal prosecution and unlimited penalty as well as the possibility of a maximum custodial sentence of two years for the employer. Notwithstanding the serious implications of these penalties, losing the ability to employ foreign workers can have a devastating impact on any business.
