The National Minimum Wage and Tips

    adams law

Although it has been commonly accepted for some time, the Central London Tribunal has confirmed that tips paid by cash or credit card will count as being paid by the employer, and thus count as wages for the purposes of the National Minimum Wage legislation.

This is only true for tips paid by the ‘tronc’ system, not for other tips. HM Revenue and Customs’ guidance note E24 had not been clear on this point.
